Pre Nuptial Agreements

“Pre Nuptial (or Pre Marriage Contracts) are becoming increasingly popular with people contemplating marriage.
 
It used to be the case that they were viewed as a negative prelude to a marriage, however they are now regarded as a sensible way of dealing proactively with issues that could create dispute or difficulty in the future.  They are mostly used to deal with financial issues, however, such agreements can take a very flexible format to suit individual requirements.

Recent case law suggests that the Courts are coming round to the idea that where such agreements are done, provided there is no suggestion of duress, they should carry increased weight in the event of marital breakdown.
