The Court’s first concern in any family
proceedings will be the welfare of minor children. In many
cases separating or separated parents will be able to deal
with issues surrounding their children by agreement as
between them. Sometimes, however, difficulties will arise
leading to outside assistance being needed to help resolve
the problems.
The following difficulties may arise:
- Problems with contact between a child and one parent
- Dispute as to residence (where a child is to live)
- Preventing a child from being unlawfully removed from a place without the consent of the other parent
- What medical treatment a child is to receive or where a child is to go to school
- Financial provision for a child over and above child maintenance particularly where there is a specific need eg a child has a disability or some other requirement
Our initial approach is to try to resolve the issue by skilled negotiation. Where this is not possible or appropriate, given the urgency of a particular situation, then a robust and proactive stance will be taken to protect the interests of your child and yourself by involving the Courts if necessary.
